Kimberly is a graduate of Lake Erie College (B.S 1996); a graduate of Cleveland State University (M.S. 2001); and a graduate of Cleveland Marshall College of Law (J.D., 2001). She was admitted to practice in 2001, and is a member of the Ohio State, Cleveland and Lake County Bar Associations. Kimberly is admitted to practice before all courts in the State of Ohio and the United States Federal Court in the Northern District of Ohio. Kimberly primarily practices in Cuyahoga, Geauga, Lake, Summit, Trumbull and Mahoning counties.

The majority of Kimberly’s practice is focused on commercial and business litigation.  Kimberly approaches business litigation matters in a highly aggressive, efficient and straightforward manner.  She recognizes that each industry is unique and that the issues and challenges specific to an industry must be understood and incorporated throughout the course of the litigation, from the onset to the conclusion.  Kimberly represents small and medium size businesses in disputes that require litigation.  Litigation most common to small business owners involve sales and purchase agreements, non-compete contracts, corporate / limited liability company / partnership dissolution, buy-sell agreements, commercial leases, and loan defaults.   

Commercial / Business Collections:

Successful business operations depend on timely payment of accounts.  When clients or customers are delinquent in paying, there are a variety of state and federal laws governing collection of business and consumer debts.  Kimberly collects delinquent accounts for many types of businesses.  She understands that each industry faces unique challenges in the collection of its debts and approaches delinquent accounts aggressively on a case by case basis.  Kimberly has the litigation experience and expertise to educate and counsel clients on how, when, and what legal mechanism will bring them the highest level of success on the debts that they are owed.

Kimberly also often assists businesses, individuals and other attorneys on collecting and executing on all types of judgments that have been rendered in their favor but remain unpaid.  She assists in reviving dormant judgments, drafting or defending post-judgment motions, and in all aspects of asset attachment.

Contract Disputes:

Contract disputes arise over virtually any type of contract or agreement.  The most common contract disputes facing small businesses are:

• sales, purchase and service agreement disputes,

• non-compete employment contract provisions,

• commercial lease disputes,

• closely held corporate shareholder agreement disputes,

• limited liability member agreement disputes, and

• partnership agreement disputes.

Kimberly counsels and aggressively leads her business clients through the various stages of litigating a contract dispute, from the onset of court action, to choosing the best suited form of alternative dispute resolution, into trial if necessary, and through post judgment execution.
